The General Terms and Conditions of Contract regulate the distance selling relationship between GURUPRO SL and the user or customer, in accordance with the legal stipulations, in particular, Law 7/1998, of April 13, on General Terms and Conditions of Contract, Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users, Organic Law 3/2018, of December 5, on the Protection of Personal Data and the guarantee of digital rights, General Data Protection Regulation (EU) 2016/679, Law 7/1996, of January 15, on the Regulation of Retail Trade, and Law 34/2002 of July 11, on Information Society Services and Electronic Commerce.

GURUPRO SL reserves the right to make any modifications it deems appropriate to these General Terms and Conditions without prior notice. Such modifications may be made through its websites, by any legally permissible means, and will be binding for as long as they are published online and until they are validly modified by subsequent changes. However, GURUPRO SL reserves the right to apply, in certain cases, Specific Terms and Conditions of Contract in preference to these General Terms and Conditions when it deems it appropriate, announcing them in a timely and proper manner. The changes referred to in this section will not affect contracts entered into before the date of their publication.

The purpose of the website is the sale of promotional products, merchandising and corporate gifts.

The duration of the contract will be linked to the delivery of the product without prejudice to the right of withdrawal.

As a user or client, you expressly declare that you know, understand, and accept the terms of use and these general terms and conditions of sale. Likewise, you declare that you are of legal age, or an emancipated minor, and have the legal capacity to access the GURUPRO SL websites and to enter into contracts through them.

You can register as a website user to make online purchases in the corresponding section of the website. In accordance with applicable data protection regulations, GURUPRO SL informs users that the personal data collected during the registration and subsequent purchase process will be incorporated into the processing system owned by GURUPRO SL, for the purpose of processing these actions by the user and managing subsequent actions arising from them.

In accordance with your rights under current data protection regulations, you may exercise your rights of access, rectification, restriction of processing, erasure, data portability, and objection to the processing of your personal data, as well as the withdrawal of consent previously given for such processing, and to ensure security in relationships with third parties and compliance services, by sending your request to the address mentioned above or to the email address INFO@GURUPRO.ES. You may also contact the competent supervisory authority to file any complaint you deem appropriate.

Once the purchase process is complete, the customer will receive an email confirmation. It is essential that the user provides a valid email address during the purchase process. Upon receiving the product at the provided delivery address, the customer will receive an invoice or order confirmation. The customer will be offered the option of receiving an electronic invoice with prior consent. Acceptance of this billing method implies that the invoice will be sent electronically and will have all the corresponding legal effects. Subsequent invoices will be provided electronically unless otherwise indicated. The customer may revoke their consent to receive electronic invoices at any time by sending an email to the address provided above.

Offer and validity

In the case of a product on sale, the sale price and its validity will always be indicated along with its essential characteristics.

In compliance with current regulations, GURUPRO SL provides information on all items for sale, their characteristics, and prices. However, GURUPRO SL reserves the right to withdraw, replace, or change the products offered through its website by simply updating the website's content. Therefore, the products offered on the website at any given time will be governed by the General Terms and Conditions of Sale in effect at that time. Furthermore, the company reserves the right to discontinue offering access to the aforementioned products at any time without prior notice.

Essential characteristics of the products

The products offered in our online store include a photograph and their essential characteristics; this information is obtained directly from the manufacturer. The product characteristics also identify the colors in which the product is available.

Guarantees

GURUPRO SL is responsible for any lack of conformity of all products offered on the website for a period of three years from delivery.

The customer will have the right to the remedy of the acquired good within a period of three years from the purchase and under the conditions and with the means of proof regulated in the Consolidated Text of the General Law for the Defense of Consumers and Users, without prejudice to the powers of GURUPRO SL to verify the veracity of the defects, their origin and the time of their appearance.

GURUPRO SL offers after-sales service for the specified period. If you receive perishable products in poor condition or past their expiration date, please contact us at INFO@GURUPRO.ES. It is essential to follow the storage instructions on the packaging and check the expiration date, always keeping your proof of purchase.

Prices

All products show the selling price in euros and include Value Added Tax (VAT). If any other tax were applicable, it would be indicated (IGIC or IPSI).

Delivery and transport costs

GURUPRO SL will charge shipping costs based on weight and volume. Shipping is free for orders over €500. Product delivery is handled by GLS, among other carriers.

GURUPRO SL is not responsible for any customs charges.

Payment methods

The customer may pay for their order using any of the following methods. During the checkout process, they must indicate their choice:

Payment by bank transfer

All transactions involving the transmission of personal or banking data are conducted in a secure environment, using a server based on the standard SSL (Secure Sockets Layer) security technology. All information you send us is encrypted as it travels across the network.

Likewise, your credit card details are entered directly on the bank's website, at the POS (Bank's Point of Sale Terminal) and are not entered or recorded on any GURUPRO SL server.

When paying with a VISA or MASTERCARD, you will always be asked for the following information: the card number, the expiry date, and a Validation Code that corresponds to the last three digits of the number printed in italics on the back of your VISA or MASTERCARD, thus offering more guarantees about the security of the transaction.

This payment method is only valid on the website.

When a purchase amount has been fraudulently or improperly charged using a payment card number, the cardholder may demand immediate cancellation of the charge. In such cases, the corresponding debit and credit entries in the accounts of the supplier and the cardholder will be made as soon as possible.

However, if the purchase was indeed made by the cardholder and the demand for a refund was not a consequence of having exercised the right of withdrawal or termination and, therefore, the cancellation of the corresponding charge was improperly demanded, the cardholder will be obliged to compensate GURUPRO SL for the damages caused as a result of said cancellation.

Order execution

GURUPRO SL undertakes to deliver the order within the timeframe stipulated for each product in its product sheet.

The availability of products offered by GURUPRO SL may vary depending on customer demand. Although GURUPRO SL updates its stock regularly, the product requested by the customer may be out of stock at that time.

In the event of non-delivery due to unavailability, GURUPRO SL will notify the customer as soon as it becomes aware of the situation, via email or the contact method provided. This notification period will not exceed the stipulated delivery timeframe. In such cases, when GURUPRO SL does not have, or cannot have, the product available within the stipulated delivery timeframe, it may offer the customer two possible solutions: 1) Supply the customer, at no additional cost, with a product of similar characteristics or superior quality; 2) Refund the amounts paid by the buyer for the canceled order.

Right of withdrawal

The buyer will have a period of fourteen calendar days to withdraw, starting from the day the customer receives the product, without any penalty and without indicating the reasons.

The customer must return the products subject to withdrawal without undue delay and in any case no later than 14 calendar days from the date on which their decision to withdraw is communicated.

The refund of the amount corresponding to the withdrawal will be made within 14 calendar days from the date on which the decision to withdraw from the contract has been effectively and unequivocally communicated and provided that the goods or products subject to withdrawal have been received beforehand; otherwise, the disbursement may be withheld until the receipt of said goods or until the Customer proves the return of the goods.

The user is informed that they will only be responsible for the decrease in value of the goods resulting from handling other than that necessary to establish their nature, characteristics or functioning.

The right of withdrawal must be exercised by notifying us via telephone to 933846041, by sending an email to INFO@GURUPRO.ES, or by sending your letter to our postal address AVD DEL VENTS 9-13 ESC A 5 1,08917 BADALONA (BARCELONA), indicating your name and the order reference.

According to Article 103 of Law 3/2014, of March 27, which amends the consolidated text of the General Law for the Defense of Consumers and Users, the supply of services or goods made to the consumer's specifications or clearly personalized, or which, by their nature, cannot be returned or may deteriorate or expire rapidly, are exempt from the right of withdrawal. The product in question falls under one of the following exceptions:

The refund

The customer must return or deliver the product directly to GURUPRO SL, at the address AVD DEL VENTS 9-13 ESC A 5 1,08917 BADALONA (BARCELONA), without undue delay, and in any case within a period
A maximum of fourteen calendar days from the date on which the right of withdrawal from the contract is exercised. The deadline will be considered met if the customer returns the product before the end of the period.

The customer will be responsible for the costs of returning the product.

Payment refund

The refund of amounts paid by the customer will be made using the same means of payment used by the customer, unless otherwise agreed.

GURUPRO SL will refund the amounts paid by the customer within 14 calendar days from the date of receipt of the right of withdrawal.

Return of defective product

If the product is not in good condition and the cause is not attributable to the customer, the customer will have the right to return the product, informing GURUPRO SL of the reason for the return through any of the means provided in these terms and conditions, at no cost to the customer. This return due to a defect or poor condition of the product will not be considered a right of withdrawal.

GURUPRO SL undertakes to assume the cost of the return and replace the product with a new one in accordance with the conditions accepted at the time of sale.

Jurisdiction

Furthermore, GURUPRO SL reserves the right to take any civil or criminal action it deems appropriate for the misuse of its website and content or for non-compliance with these conditions.

The relationship between the user and the service provider will be governed by the laws in force and applicable in Spain. In the event of any dispute, the parties may submit their conflicts to arbitration or resort to the ordinary courts, complying with the rules on jurisdiction and venue. GURUPRO SL is domiciled in Barcelona, Spain.
